failsafe config doesn't work

Currently we have some phases, were the API server is not available. In this phases the player couldn't connect to our servers!
So there is an configuration option for this scenario: failsafe=false (which is the default)
But this option doesn't work. I checked the source code and the option is never used!
Please fix this, we want to use MCBans, but this phases are horrible for the players.
