ppl can port to it, however the spawnprotection is prevent ppl from using the waystone at spawn (we tested out with and without spawn-protection. without it was useable, with protection it was un-useable)

That is Vanilla behaviour, spawn protection will prevent players from any interactions with blocks. Disable spawn protection if you want to use Waystones near spawn, or use a spawn protection mod that can whitelist certain blocks.
